Terms of Service

You must be at least 18 years old and a resident of Australia to use the Platform. By using the Platform, you represent and warrant that you meet these requirements.

• You must provide accurate, current and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorised use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

When creating a vehicle listing, you agree that:

• You are the legal owner of the vehicle or authorised to sell it.
• All information provided (price, condition, specifications, photos) is accurate and not misleading.
• The vehicle is legally registered and roadworthy, or clearly described otherwise.
• You will not list stolen, encumbered (with an outstanding loan) or illegally modified vehicles.
• Listings are for vehicles only — no parts, accessories or non-vehicle items.
• We reserve the right to remove any listing at our discretion without notice.

Free accounts may list up to 3 vehicles. Pro and Elite dealer accounts have higher limits as described in the pricing page.

etricauto is a marketplace only. We do not facilitate, guarantee or take responsibility for any transaction between buyers and sellers. All sales are conducted directly between parties. You are solely responsible for:

• Verifying the identity of the other party
• Inspecting the vehicle before purchase
• Conducting a PPSR (Personal Property Securities Register) check
• Arranging payment safely (we recommend bank transfer or escrow — never cash for large amounts)
• Completing all required transfer of ownership paperwork in your state

etricauto accepts no liability for any loss, damage or dispute arising from a transaction conducted through the Platform.

Dealer Pro ($49/month) and Elite ($149/month) plans are billed monthly via Stripe. By subscribing:

• You authorise us to charge your payment method on a recurring monthly basis.
• You may cancel at any time — your plan remains active until the end of the current billing period.
• We do not offer refunds for partial months.
• We reserve the right to change pricing with 30 days notice.
• Downgrading to the Free plan will remove Pro/Elite features at the end of the billing period.

You must not:

• Post false, misleading or fraudulent listings
• Harass, abuse or threaten other users
• Use the Platform for any unlawful purpose
• Scrape, copy or redistribute Platform content without permission
• Attempt to gain unauthorised access to any part of the Platform
• Post spam, unsolicited commercial messages or malicious content
• Impersonate any person or organisation

Violation may result in immediate account suspension and referral to law enforcement.

All content on the Platform (excluding user-submitted content) — including design, text, logos, software and tools — is owned by etricauto and protected by Australian copyright law. You may not reproduce or distribute any part of the Platform without our written permission.

By submitting content (photos, descriptions) to the Platform, you grant us a non-exclusive, royalty-free, worldwide licence to use, display and distribute that content in connection with operating the Platform.

The Platform is provided "as is" without warranties of any kind. We do not warrant that the Platform will be uninterrupted, error-free or free of viruses. We make no representations about the accuracy or completeness of any listing information.

To the maximum extent permitted by Australian law, etricauto and its directors, employees and agents are not liable for any indirect, incidental, special or consequential damages arising from your use of the Platform, including loss of data, revenue or profit.

Where liability cannot be excluded under the Australian Consumer Law, our liability is limited to re-supplying the relevant service.

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

We may update these Terms from time to time. We will notify registered users of material changes by email or Platform notice. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
